FAQ

Personal Injury — Common Questions

How much does it cost to hire a personal injury attorney?
Personal injury cases are generally handled on a contingency basis, meaning the fee is a percentage of the recovery and there is no fee unless you recover. Your first consultation with Krankemann Law is free and confidential. We will explain the fee structure clearly before you decide to move forward.
Should I accept the insurance company's first offer?
Early offers are often made before the full extent of your injuries and future costs is known. Once you accept and sign a release, you generally cannot reopen the claim. It is worth having an attorney review any offer before you respond.
What if I was partly at fault for the accident?
California follows a comparative negligence rule, which means you can still recover even if you were partially at fault. Your recovery is reduced by your percentage of responsibility. Being partly at fault does not bar your claim.
How long do I have to file a claim in California?
For most personal injury claims, the deadline is generally two years from the date of the injury. Claims against a government entity have a much shorter window, often six months to file a formal claim. Talk to a lawyer early so a deadline does not foreclose your case.
